Changes to the NSW Residential Tenancy Agreement

On 28 September 2020, the standard form of the NSW Residential Tenancy Agreement changed.

These changes were enacted pursuant to amendments made to the Residential Tenancies Amendment (Miscellaneous) Regulation 2020 (NSW) and the Better Regulation Legislation Amendment Act 2020 (NSW).

The standard forms have been updated to reflect these amendments.

If you have entered into a lease agreement on and from 28 September 2020 that do not have these changes implemented, please arrange for the linked Addendum to be sent to tenants accordingly, to ensure complete compliance with the legislative requirements.

In accordance with the new clause 37.5, you are required to notify tenants if the landlord resides outside of NSW.

For leases entered into on and from 28 September 2020, where a landlord resides outside of NSW, we recommend you notify the tenant in writing of where the landlord ordinarily resides, if this information is not outlined on the lease agreement, pursuant to the new clause 37.5.
